By accessing or using CloudX (cloudxhq.com), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

These Terms constitute a legally binding agreement between you and CloudX. Please read them carefully.

2. Description of Service

CloudX provides encrypted file storage and sharing services. Our service includes:

• Secure file storage with AES-256 bit server-side encryption
• File upload and download capabilities
• Multiple subscription tiers with varying storage and bandwidth limits
• Secure infrastructure with protected access controls

CloudX is designed to protect your data from unauthorized access and AI algorithms that seek to analyze or exploit user data.

3. Account Registration

To use CloudX, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

You must be at least 13 years old to create an account. Users under 18 should have parental consent.

4. Subscription Plans

Free Plan

Our Free Plan is free forever and includes:

• Limited storage space
• 2 MB/s bandwidth (16 Mbps upload and download)
• All core features
• No credit card required

Paid Plans

We offer Basic, Plus, and Pro subscription plans with increased storage and bandwidth:

• Basic Plan: 4 MB/s bandwidth (32 Mbps)
• Plus Plan: 6 MB/s bandwidth (48 Mbps)
• Pro Plan: 10 MB/s bandwidth (80 Mbps)

Paid subscriptions are ongoing and will continue until you cancel or CloudX ceases operations.

Bandwidth Requirements

To take full advantage of your plan's allocated bandwidth, ensure your internet connection speed meets or exceeds the plan limits. Note that 1 MB/s equals 8 Mbps. Bandwidth speeds apply to both uploads and downloads.

5. Payment and Billing

For paid plans:

• Payments are processed securely through our payment processor
• Subscriptions automatically renew unless cancelled
• You can cancel your subscription at any time
• Refunds are handled on a case-by-case basis
• Price changes will be communicated with 30 days advance notice

6. Acceptable Use Policy

You May Use CloudX To:

• Store and share your personal and professional files
• Back up your data securely
• Collaborate with others on projects
• Access your files from anywhere

You May Not Use CloudX To:

• Upload, store, or share illegal content
• Distribute malware, viruses, or malicious software
• Infringe on intellectual property rights
• Store child sexual abuse material or any content exploiting minors
• Engage in harassment, hate speech, or threats
• Attempt to breach security or access other users' accounts
• Use the service to spam or send unsolicited communications
• Violate any applicable laws or regulations
• Resell or redistribute the service without authorization

Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.

7. File Security and Privacy

Encryption

All files uploaded to CloudX are encrypted server-side using AES-256 bit encryption. This means:

• Your files are encrypted at rest on our servers
• Server-side encryption protects your data in storage
• Files are securely transmitted via HTTPS

Virus Scanning

We perform automated virus scanning on files before upload to protect our infrastructure and users. After the virus scan, files are immediately encrypted. We do not:

• Scan files for content beyond virus detection
• Use AI or machine learning on your files
• Sell, share, or analyze your file contents

Your Responsibility

While we encrypt your files, you are responsible for:

• Maintaining secure passwords
• Not sharing your account credentials
• Ensuring you have the right to upload and store the files you submit

8. Data Retention and Deletion

Your files remain on our servers as long as you maintain an active account. You may:

• Delete files at any time
• Close your account at any time
• Export all your files before closing your account

Upon account closure, all files and associated data will be permanently deleted within 30 days. This deletion is irreversible.

9. Service Availability

We strive to maintain 99.9% uptime, but we cannot guarantee uninterrupted service. CloudX may be temporarily unavailable due to:

• Scheduled maintenance (announced in advance)
• Unexpected technical issues
• Force majeure events

We are not liable for any losses resulting from service interruptions.

10. Service Termination

Your Right to Terminate

You may terminate your account at any time by closing it through your account settings. Paid subscriptions can be cancelled, but fees already paid are non-refundable except as required by law.

Our Right to Terminate

We may suspend or terminate your account if:

• You violate these Terms of Service
• You engage in illegal activities
• Your payment fails (for paid plans)
• Required by law

Service Discontinuation

If CloudX ceases operations, we will provide you with 30 days advance notice. During this period, you will have full access to download all your files. After the notice period, all data will be permanently deleted.

11. Intellectual Property

Your Content

You retain all ownership rights to the files you upload to CloudX. By using our service, you grant us only the limited rights necessary to:

• Store your encrypted files on our servers
• Transmit your files when you request downloads or shares
• Perform virus scanning before encryption

We do not claim ownership of your files and will never use them for any purpose beyond providing the service.

CloudX Property

The CloudX service, including all software, design, logos, and trademarks, is owned by CloudX and protected by copyright and trademark laws. You may not:

• Copy or modify our software
• Reverse engineer our platform
• Use our branding without permission

12. Limitation of Liability

To the maximum extent permitted by law, CloudX and its operators shall not be liable for:

• Loss of data due to user error or account closure
• Indirect, incidental, or consequential damages
• Loss of profits or business opportunities
• Service interruptions or data transmission errors

Our total liability for any claim arising from your use of CloudX shall not exceed the amount you paid us in the 12 months preceding the claim.

Important: While we use industry-standard encryption and security measures, no system is completely secure. You should maintain backups of critical files.

13. Disclaimer of Warranties

CloudX is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free service

14. Indemnification

You agree to indemnify and hold harmless CloudX, its operators, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any law or rights of third parties
• Content you upload to the service

15. Privacy and Data Protection

Your use of CloudX is also governed by our Privacy Policy, which explains how we handle your data. Key points include:
